Statistics show where parties to a dispute agree to mediate first, they are more likely to achieve a satisfactory outcome and in less time than through pursuing litigation alone. One of the benefits to mediation is that it is a cost effective alternative to litigation. In mediation, you cannot lose. In other words, you make the decisions. Whereas in litigation a judge or jury makes the decision on behalf of the parties, in mediation, the parties determine what is in their best interest. Moreover, mediation is not limited by rules of evidence or legal relevance. All issues important to the parties, whether legal or non-legal, can be discussed. Mediation is flexible; creative solutions can be decided upon that would not be possible in court. Most importantly, mediation is a self-determinative process. The mediator will help the parties focus their attention and break the areas of dispute into more manageable pieces so that a mutually suitable agreement can be reached. Unfortunately, not all disputes can be resolved at the mediation table. Where this happens, the case can still be handled by the court or resolved by some other means.
